By accessing or using the Trivia Anywhere platform ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Trivia Anywhere ("we," "us," or "our").
Trivia Anywhere is an interactive platform that allows hosts to create and manage live trivia, bingo, polling, Q&A, and other interactive experiences, and allows players to participate in those experiences via a web browser. The Service is offered through free and paid subscription tiers with varying feature sets and usage limits.
You agree not to:
Hosts retain ownership of content they upload (questions, images, branding assets). By uploading content, you grant Trivia Anywhere a non-exclusive, worldwide license to store, display, and distribute that content as needed to operate the Service.
You are solely responsible for ensuring your content does not violate any laws or third-party rights. We reserve the right to remove content that violates these Terms at any time, with or without notice.
When a host enables lead capture, players who provide their information consent to have that data collected and processed. This may include:

When hosts collect personal data from players through lead capture or game participation, they act as independent data controllers under applicable data protection laws (including GDPR). Hosts are responsible for:
Trivia Anywhere acts as a data processor on behalf of hosts for lead capture data. We process this data only as instructed by the host and in accordance with our Privacy Policy.
We use analytics cookies (Google Analytics, Microsoft Clarity) to improve the Service. These are loaded only after you provide consent via our cookie banner. You can change your cookie preferences at any time by clearing your browser's local storage.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Trivia Anywhere expressly disclaims all warranties, including but not limited to:
No oral or written information or advice given by Trivia Anywhere or its representatives shall create any warranty not expressly stated in these Terms.
To the maximum extent permitted by applicable law, Trivia Anywhere, its operators, affiliates, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of — or inability to use — the Service. This includes, without limitation, damages for:
Aggregate Liability Cap: In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Service exceed the greater of: (a) the total amount you paid to Trivia Anywhere in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars (US $50.00). This cap applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Large Events & High-Traffic Situations: Trivia Anywhere makes no guarantee of performance, availability, or reliability for events with large numbers of concurrent participants. We are not responsible for service degradation, latency, disconnections, data loss, score corruption, or complete service failure resulting from high player counts, network congestion, third-party infrastructure limitations, or overuse of the platform. Hosts assume full responsibility for independently assessing whether the Service is suitable for their intended event size and use case before the event begins.
System Failures & Force Majeure: We are not liable for any failure or interruption of the Service caused by circumstances beyond our reasonable control, including but not limited to: acts of God, internet outages, BGP routing failures, DNS failures, third-party service failures (including cloud providers such as Google Firebase/GCP, database providers, and content delivery networks), cyberattacks, DDoS attacks, power failures, hardware failures, software bugs, government restrictions, pandemics, or any other cause outside our direct control.
No Liability for Real-World Consequences: We shall have no liability for any real-world consequences of a game session failure, including but not limited to: disrupted corporate events, classroom disruptions, lost prizes or awards, costs incurred by hosts or players in preparation for or attendance at an event, or any other consequential loss arising from the Service failing to perform as expected.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law.
Trivia Anywhere offers free and paid subscription plans. By subscribing to a paid plan, you agree to the following terms:
We strive to keep the Service available but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable to you or to any third party for any modification, suspension, or discontinuation of the Service.
Right to Cap or Cancel Games: Trivia Anywhere reserves the right, at its sole discretion, to cap participant counts, throttle connections, pause, or terminate any active game session at any time and for any reason — including but not limited to: excessive resource consumption, suspected abuse, platform stability concerns, or overuse relative to the host's plan. We are not liable for any disruption, loss of game progress, or impact to your event caused by such actions.
Data Control & Deletion: Trivia Anywhere reserves the right to delete, purge, or modify any user-generated content, game data, participant records, analytics data, or account data at any time, with or without notice, and without requiring your consent. This includes but is not limited to: routine data cleanup operations, capacity management, compliance requirements, and account termination. You should not rely on the Service as your sole or long-term storage for any data. We strongly recommend maintaining your own backups of all game data, participant information, and results.
Third-Party Dependencies: The Service relies on third-party infrastructure providers including but not limited to Google Firebase, Google Cloud Platform, and content delivery networks. We are not responsible for failures, outages, or degraded performance caused by these third-party providers, and we make no representation that such third-party services will be available or error-free at any time.
We may terminate or suspend your access to the Service — including any active paid subscription — at any time, with or without notice, for any reason, including but not limited to: conduct that we believe violates these Terms, excessive use relative to your plan, abuse of the platform, or any other reason at our sole discretion. Upon termination:
Voluntary Cancellation: To cancel your subscription, you must submit your cancellation request at least five (5) days prior to your next billing date. Cancellation requests submitted fewer than 5 days before the billing date will not take effect until the following billing cycle, and you will be charged for the upcoming period. All cancellation requests must include a reason for cancellation; requests submitted without a reason may not be processed. Upon successful cancellation, your paid features will remain active until the end of the current billing period. No partial refunds will be issued for unused time.
Survival: Sections 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 13 (Indemnification), 14 (Dispute Resolution & Arbitration), 15 (Governing Law), and all payment obligations shall survive any termination or expiration of these Terms.
You agree to indemnify, defend, and hold harmless Trivia Anywhere, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you upload or distribute through the Service; or (e) any claim by a player or attendee at an event you hosted using the Service, including claims related to service failures, data loss, or disruption of the event.

Informal Resolution First: Before initiating any formal dispute, you agree to contact us at support@triviaanywhere.com and give us at least thirty (30) days to attempt to resolve the dispute informally.
Binding Arbitration: If we cannot resolve a dispute informally, you and Trivia Anywhere agree to resolve any claim, dispute, or controversy arising out of or in connection with these Terms or the Service through binding individual arbitration, rather than in court. Arbitration shall be conducted under the rules of the American Arbitration Association ("AAA") Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English, and the arbitrator's award shall be final and binding.
Class Action Waiver: You and Trivia Anywhere each waive the right to bring any dispute as a class action, collective action, or representative action. You may only bring claims against Trivia Anywhere in your individual capacity. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Exceptions: Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm. Claims for intellectual property infringement may also be brought in court.
Time Limit on Claims: Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year of the date the claim arose, or it is permanently barred.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles. Any dispute not subject to arbitration under Section 14 shall be resolved exclusively in the federal or state courts located in the United States, and you consent to personal jurisdiction in such courts.
If you are located in the EEA or UK, nothing in these Terms affects your statutory rights under the GDPR or other mandatory local consumer protection laws that cannot be waived by contract.
Any references to third-party products, services, or platforms (including but not limited to Kahoot, Blooket, Quizlet, and similar products) are for descriptive comparison purposes only. Trivia Anywhere is not affiliated with, endorsed by, or in partnership with any third-party platform mentioned on the Service or its website.
These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features of the Service, constitute the entire agreement between you and Trivia Anywhere regarding the Service and supersede all prior agreements, understandings, representations, and warranties.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or — if modification is not possible — severed from these Terms, and the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
We may update these Terms from time to time at our sole discretion. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. For material changes, we may provide notice through the platform or via email to the address associated with your account. It is your responsibility to review these Terms periodically.
